Purchase and Sales agreement

(please make all checks payable to Jennifer Cadwell)

This agreement is made between Jennifer Cadwell, residing in Oak Run, CA, hereinafter referred to as “SELLER” and _____________________________, residing in ______________________________, hereinafter referred to as "BUYER" for the purchase and sale of the horse described below on the following terms and conditions of sale:

Consideration

In consideration of the total sum of $_____________________, SELLER agrees to sell BUYER the horse described herein and the BUYER agrees to buy said horse on the terms set forth herein.

Payment Terms

BUYER agrees to pay a $_________________ non-refundable deposit and $___________________ minimum monthly payments commencing no later than one month after completion of this contract until the horse is paid for in full. Any payment not received within 10 days of the expected payment date will be deemed late. Should it be necessary for payments to extend past the foal’s age of 6 months then a $75 (Seventy Five Dollar) per month board fee may be applied. This board fee is to cover the cost of feed and farrier while the foal is still in the possession of the Seller. In the event that the mare does not deliver a live healthy foal or the foal does not remain healthy until weaning then all money paid by Buyer (including the deposit) will be refunded in full. Any deviation from payment terms without written consent of Seller will render this contract null and void and said horse may be put back up for sale. The deposit plus a 10% cancellation fee will be retained by Seller and all other money paid by Buyer will be returned.

Possession

Buyer may take possession of said horse after the foal is weaned and when purchase price is paid in full. All transportation costs are the responsibility of the Buyer.

Warranties

Seller warrants she has clear title to said horse.

Seller warrants the following:

Seller guarantees a live healthy foal at time of weaning

Said horse will be registered with the GHRA at Seller’s expense

Seller will administer a foal IgG test at birth and all appropriate vaccinations, deworming and feed until said horse is transferred to Buyer.

Seller of horse makes no further warranties.

Buyer agrees to buy horse as is.

Registration and Ownership Transfers

Upon payment in full, SELLER agrees to execute all papers necessary to transfer ownership to BUYER. BUYER will pay all transfer fees.
